Liability Insurance
All exhibitors shall, at their own expense, provide Commercial General Liability coverage for their own operation and it shall be their responsibility to show evidence of Bodily Injury and Property Damage coverage of no less than $1,000,000 per occurrence for Bodily Injury and Property Damage, with an aggregate limit of $2,000,000. The insurance requirements of $1,000,000 may be reduced to $300,000 for non-hazardous displays but only after approval in writing by Maine Boats, Homes & Harbors, Inc. (This will not include boats in the water or on land that are displayed for the purpose of boarding.) Exhibitors shall not be allowed to set up without a Certificate of Insurance being on file naming Maine Boats, Homes & Harbors, Inc. as an “ADDITIONAL INSURED.” The insurance company providing this coverage must be licensed to do business in the State of Maine and must have a “Best Rating” of A- or better, or be a company acceptable to Maine Boats, Homes & Harbors, Inc. Certificates of Insurance shall be mailed to Maine Boats, Homes & Harbors, Inc., P.O. Box 758, Camden, ME 04843 or faxed to 207-236-0811.
Neither Maine Boats, Homes & Harbors, Inc., or its employees, will be responsible for any injury to exhibitors, their employees, invitees, guests or visitors within the confines of the space, or spaces, contracted for by the exhibitor or within the confines of the Show, or in the event the exhibitor takes a boat away from the space in a demonstration or otherwise. Exhibitor does hereby indemnify, save and hold harmless, Maine Boats, Homes & Harbors, Inc., their officers, directors or employees, from any suit for claim of bodily injury, personal injury, property damage or for loss of use of property by whomever sustained on or about Exhibitor’s display, boat or otherwise, or arising out of Exhibitor’s participation in the Show, in any capacity, unless damage or injury is due solely to the negligence of Maine Boats, Homes & Harbors, Inc. Said indemnification shall include Maine Boats, Homes & Harbors, Inc. attorney’s fees or other costs. Exhibitor hereby indemnifies and does hereby hold Maine Boats, Homes & Harbors, Inc. harmless for all costs and fees incurred by Maine Boats, Homes & Harbors, Inc. in arbitrating or defending any action legal or otherwise brought by any manufacturer, distributor, dealer or other exhibitor who threatens to or in fact sues Maine Boats, Homes & Harbors, Inc. to remove an exhibitor from the Show. Exhibitors shall be solely responsible for securing their displays and materials at all times. Maine Boats, Homes & Harbors, Inc. shall not in any event be liable for consequential damages, lost profits or any other similar damages.
